House Democrats Contemplate Abolishing 401(k) Tax Breaks
Powerful House Democrats are eyeing proposals to overhaul the nation’s $3 trillion 401(k) system, including the elimination of most of the $80 billion in annual tax breaks that 401(k) investors receive.
House Education and Labor Committee Chairman George Miller, D-California, and Rep. Jim McDermott, D-Washington, chairman of the House Ways and Means Committee’s Subcommittee on Income Security and Family Support, are looking at redirecting those tax breaks to a new system of guaranteed retirement accounts to which all workers would be obliged to contribute.
A plan by Teresa Ghilarducci, professor of economic-policy analysis at the New School for Social Research in New York, contains elements that are being considered. Under Ghilarducci’s plan, all workers would receive a $600 annual inflation-adjusted subsidy from the U.S. government but would be required to invest 5 percent of their pay into a guaranteed retirement account administered by the Social Security Administration. The money in turn would be invested in special government bonds that would pay 3 percent a year, adjusted for inflation.
The current system of providing tax breaks on 401(k) contributions and earnings would be eliminated.
“From where I sit that’s just crazy,” said John Belluardo, president of Stewardship Financial Services Inc. in Tarrytown, New York. “A lot of people contribute to their 401(k)s because of the match of the employer,” he said.
Higher-income employers provide matching funds to employee plans so that they can qualify for tax benefits for their own defined-contribution plans, he said.
“If the tax deferral goes away, the employers have no reason to do the matches, which primarily help people in the lower income brackets,” Belluardo said.
“This is a battle between liberalism and conservatism,” said Christopher Van Slyke, a partner in the La Jolla, California, advisory firm Trovena, which manages $400 million. “People are afraid because their accounts are seeing some volatility, so Democrats will seize on the opportunity to attack a program where investors control their own destiny,” he said.
The Profit Sharing/401(k) Council of America in Chicago, which represents employers that sponsor defined-contribution plans, is “staunchly committed to keeping the employee benefit system in America voluntary,” said Ed Ferrigno, vice president in the Washington office.
“Some of the tenor that the entire system should be based on the activities of the markets in the last 90 days is not the way to judge the system,” he said.

Man Not Guilty In Open Carry Gun Case
West Allis, Wisconsin - As Brad Krause planted a tree in his yard last summer, a neighbor noticed that in addition to a shovel, Krause had a tool not usually required for yard work – a gun in a holster.
Police arrived and gave Krause a ticket alleging disorderly conduct, launching a case that a national gun-rights group has been watching for months.
On Tuesday, Krause won acquittal in what some advocates say is one of the first so-called open-carry gun cases heard in a Wisconsin court.
Municipal Judge Paul Murphy said he had reviewed several state statutes and court cases related to the right to keep and bear arms. “There being no law whatsoever dealing with the issue of an unconcealed weapon or the so-called open carry is why we’re here today,” Murphy said.
In the end, he determined Krause’s actions did not rise to disorderly conduct and found him not guilty.
City Attorney Scott Post declined to comment Tuesday.
Police responded to Krause’s home in August after the neighbor called. They arrested Krause, gave him a disorderly conduct ticket and seized his gun.
Krause hired an attorney, Steven Cain, and fought the charge during a court trial in December.
After Murphy’s ruling Tuesday, Krause said the significance of the case extends beyond gun rights.
“The reason people are upset about this is it’s not about guns. It’s about civil liberties. And we obviously have a property issue. There was no warrant issued, no exigent circumstances, no permission to enter the property, yet the police stormed in with guns drawn and put my life at risk,” Krause said. Asked why he was carrying a gun to plant a tree, Krause said, “There’s no requirement to justify why you’re able to exercise constitutional rights. I and everyone else are able to go to church, they’re able to vote, they’re able to speak their mind. Even though the city might not like it, we have that right.”
His attorney said the overarching issue in the case was whether it is legal to openly carry a gun.
“The law in Wisconsin really only limits concealed carry,” Cain said. Cain argued that the U.S. Supreme Court decision last year that found Washington, D.C.’s gun ban unconstitutional concluded that open carry is “an individual right that shouldn’t be abridged by law enforcement. That’s what the case is generally all about.”
West Allis Deputy Chief Rick Balistrieri said Tuesday’s verdict will not change the way his officers respond to similar calls, noting they must assess all calls on a case-by-case basis, particularly when a gun is involved.
Krause’s case had been one of several around the country followed closely and promoted by Virginia-based OpenCarry.org.
“Really, the larger issue is not even a gun rights issue,” said organization co-founder John Pierce. “It’s the issue of having a disorderly conduct statute that is a catch-all statute for otherwise legal behavior.”

Let the 2010 Mid-Terms BEGIN!
Nevada Senator Harry Reid played a key role in shaping the American Recovery and Reinvestment Act (aka The Congressional Relief Action Program (CRAP)).
Due to Reid’s lack of wisdom, the economic recovery package will deliver nothing but more debt resulting in higher taxes for Nevadans and the rest of the nation. From start to finish, Reid has kept his focus on the left wing of the party and Obama by pushing for provisions that will not create jobs, not cut taxes for struggling families and will weaken the economy.
This lying sack of excrement had the audacity to proclaim: “This recovery package is going to be good for Nevada,” Reid said. “It will create jobs in our state while improving our roads, bridges and public transportation. It also cuts taxes for working families who are struggling just to get by. And tax incentives will create renewable energy jobs, putting Nevadans to work turning our abundant natural resources into the energy we need to power our state.”
If you believe that statement, I have one of the bridges, Reid mentioned above, for sale!
Shame on you, Senator Reid, for selling out the American people and voting for this Big Spending Bill!
Keep in mind Mike Huckabee’s suggestion, “You can vote these guys out of office and tell them that you aren’t going to take their Congressional Relief Action Program anymore.”
Senator Reid is coming up for re-election in 2010. Let’s send him a message that we will not tolerate his liberal, big spending, hyper partisan, politics anymore.

Senator Ensign Votes No On So-Called Stimulus Bill
Washington, D.C. – Senator John Ensign, (R – NV) Chairman of the Republican Policy Committee, voted against the so-called stimulus bill today because it costs more than a trillion dollars when you add interest, includes reckless spending and does little to help small businesses and homeowners. After the vote, Senator Ensign released the following statement:
“Today’s vote is more of the same in Washington – spend, spend, spend. Government has a role to play, but the American people deserve a better effort than this. For Nevada, when you peel back a few layers, this bill is not as beneficial as it first looks, and it will ultimately increase taxes.
“Let’s consider education funding for Nevada in this bill. According to the Congressional Research Service and the Census Bureau, Nevada ranks last in education funding per capita. As a result of this so-called stimulus bill, Nevadans will pay higher taxes to subsidize education in other parts of the country.
“Let’s talk about taxes, because this bill has plenty. Not only will this bill increase your taxes but it includes few tax incentives for small business, which historically pulls our economy out of recessions. This bill overlooks small business yet rewards General Motors with a $3 billion tax earmark exclusively for them.
“When you look at the spending in this bill, it’s even worse. Tax relief only makes up 25 percent of the bill, so a large bulk is more government spending. With only a day or so to read the bill, we’ve already found $165 million for fish hatcheries and up to $3 billion for groups like ACORN, a group we learned a lot about in Nevada late last year.
“I believe Congress squandered a unique opportunity. If the process started with Democrats and Republicans working together, we could have achieved more for the American people. We should have sent President Obama a truly bipartisan bill that fixes housing, creates jobs and boosts our economy.”

“Just like the bailout, this legislation will prove to be a colossal waste of taxpayer dollars. In less than a month, the majority party has gone on a spending spree—expanding government and creating record debt for our country. This bill will not jump start our economy, increase productivity, or create or save jobs. Instead of providing expanded tax relief to help middle class families and small businesses, Congress has determined that big government is the answer. This bill which was conceived and written behind closed doors does a great disservice to Nevadans and the American people,” said Heller.

California to Free 55,000 Prisoners
There’s not been a greater escape since Steve McQueen jumped aboard his motorcycle. The state of California has been ordered to release more than 55,000 prison inmates to ease pressure on its ailing penal system.
Federal judges ruled last week that California’s 33 adult jails have become so overcrowded that they violate the constitutional rights of inmates, subjecting them to “cruel and unusual” punishment that is causing at least one death a month. Just over a third of the state’s 158,000 prisoners must be set free by 2012 to ensure that basic healthcare is provided to those who remain behind, the judges said.
Critics claim the ruling amounts to throwing open the doors of the biggest prison system in America, and will endanger the public. A public who have been disarmed over the years with some of the most foolish and stringent gun control laws in the nation.
The prison crisis is not limited to California. In Des Moines, Iowa, county officials plan to start charging prisoners for toilet paper. Michigan, where Detroit has America’s highest murder rate, will release 4,000 prisoners who have served their minimum sentences. New Jersey, Carolina and Vermont are putting drug-addicted offenders into treatment rather than prison. Louisiana, which has one of the highest incarceration rates in the developed world, is hoping to reform a system that spends more on prisons than on higher education.

The Massive Spending Bill, Which The Democrats Refer to as a Stimulus Bill, Needs An Official Title

First we had the TARP bailout last fall – the Troubled Assets Relief Program.
Congress spent about $750 billion to fix the economy.
Things got worse and Congress doesn’t even know what happened to a big chunk of the money.
This week, Congress ignored all those promises for bipartisanship and transparency by locking the Republicans out of the room, holing up in secret middle of the night meetings, and then hurriedly voting on an 1,100 page bill that not one of the Senate or House members had the time to even read, much less understand.
They were in such a hurry to get this passed, that they didn’t have a name for it, so in the interest of public service, I’d like to offer a title for this massive spending bill: The Congressional Relief Action Program.
What could be more appropriate than calling it what it is and what it’s likely to be in really helping bring jobs other than the guaranteed employment for the 35,000 lobbyists in Washington who will now be going crazy trying to find ways to get a chunk of the Congressional Relief Action Program money for their clients.
And they will surely find a way – they always do.
But you can rest assured that Congress had you in mind when they passed this Congressional Relief Action Program. They knew that you if you knew what this Congressional Relief Action Program had in it, you’d be ready to kick the Congressional Relief Action Program out of them so they passed it before you or they could read it.
Of course, when the people of this nation get tired of this Congressional Relief Action Program, they can do something about it.
You can vote these guys out of office and tell them that you aren’t going to take their Congressional Relief Action Program anymore.
